DMCA Policy

Aivius, Inc. ("Aivius," "we," or "us") respects the intellectual property rights of others and expects users of our Service to do the same. This Digital Millennium Copyright Act (DMCA) Policy describes how copyright owners (or their authorized agents) can report allegedly infringing content on the Aivius platform, how we respond to such reports, and how users can submit a counter-notification if they believe content was removed in error.

This policy is implemented in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA"), and applies to content hosted on or made available through aivius.ai and the Aivius Service. A physical or electronic signature of a person authorized to act on behalf of the copyright owner is required for all notices and counter-notifications described below.

Reporting Copyright Infringement

If you believe that content available on or through the Aivius Service infringes a copyright you own or control, you (or your authorized agent) may submit a DMCA notice to our designated copyright agent at the contact information listed in the "Designated Copyright Agent" section below.

Before filing a notice, please consider whether the use of the content may be protected by fair use or another exception under copyright law. The DMCA is not the appropriate mechanism for reporting content that you simply disagree with or that does not actually infringe your copyright.

Upon receipt of a valid DMCA notice, Aivius will expeditiously remove or disable access to the allegedly infringing material and will notify the user who posted it (if applicable) that we have done so. If the user believes the material was removed in error, they may submit a counter-notification as described below.

DMCA Notice Requirements

To be effective under the DMCA (17 U.S.C. § 512(c)(3)), your notice of alleged copyright infringement must include the following elements in writing:

  1. Identification of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notice, you may provide a representative list of such works.
  2. Identification of the allegedly infringing material that is to be removed or access to which is to be disabled, including the URL or other specific location on the Aivius Service where the material is located. This must be specific enough for us to locate the material.
  3. Your contact information, including your full name, mailing address, telephone number, and email address, so that we may contact you about your notice.
  4. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notice is accurate, and under penalty of perjury, that you are the owner of the copyright that is allegedly infringed, or that you are authorized to act on behalf of the copyright owner.
  6. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. For electronic notices, typing your full legal name at the end of the email constitutes an electronic signature.

Notices that do not include all six elements above may not be effective under the DMCA and may delay our response. If your notice is incomplete, we may request additional information before taking action.

Counter-Notification

If your content was removed from the Aivius Service in response to a DMCA notice and you believe the removal was in error (for example, because you have the right to use the material, or the material is not infringing), you may submit a counter-notification to our designated copyright agent.

To be effective under the DMCA (17 U.S.C. § 512(g)(3)), your counter-notification must include the following:

  1. Identification of the material that has been removed and the location at which it appeared before it was removed.
  2. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Your contact information, including your full name, mailing address, telephone number, and email address.
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Aivius may be found), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
  5. Your physical or electronic signature.

Upon receipt of a valid counter-notification, Aivius will forward a copy to the original complaining party and inform them that we will restore the removed material (or cease disabling access to it) in 10 business days, unless our designated copyright agent first receives notice from the complaining party that they have filed a court action seeking to restrain the alleged infringement. If we do not receive such notice, we will restore the material.

Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), Aivius maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. A "repeat infringer" is a user who has been the subject of two or more valid DMCA notices within a 12-month period for content posted to the Aivius Service.

We will also terminate the account of any user who, after receiving a DMCA notice and counter-notifying, is found by a court to have infringed the copyright at issue. Account termination under this policy is permanent and includes forfeiture of any prepaid subscription fees, except where prohibited by law.

We reserve the right to suspend or terminate accounts for a single instance of egregious infringement, even without a prior DMCA notice, where the infringement is clear and willful (for example, large-scale distribution of pirated content).

For faster processing, we recommend sending notices by email. We monitor the copyright@aivius.ai inbox during US business hours and aim to acknowledge all notices within 1 business day of receipt. Physical mail may take longer to process.

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability. Do not make false claims — see the "False Claims Warning" below.

False Claims Warning

Filing a false DMCA notice or counter-notification is a serious matter. Under 17 U.S.C. § 512(f), any person who knowingly makes a material misrepresentation in a DMCA notice or counter-notification may be liable for damages, including any damages suffered by the alleged infringer and Aivius as a result of the misrepresentation, including costs and attorney's fees.

Before filing a notice, please confirm that:

  • You actually own or are authorized to act on behalf of the copyright owner for the work in question.
  • The material you are reporting is genuinely infringing and not protected by fair use, a license, the public domain, or another copyright exception.
  • The URL or location you have provided is accurate and corresponds to the material you believe infringes your copyright.

Aivius reserves the right to seek damages from any person who submits a false or bad-faith DMCA notice, to the fullest extent permitted by law. We may also, in appropriate circumstances, terminate the accounts of users who repeatedly submit false notices.

Changes to This Policy

We may update this DMCA Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes (such as a change of designated agent) will be posted prominently on this page. We encourage you to review this page periodically.
